Mapping Application Terms of Use

Home Mapping Application Terms of Use

In addition to the standard Terms of Use which apply to the use of the St. Clair Region Conservation Authority website, the following applies when using mapping applications provided on the SCRCA Website (“Website”).

St. Clair Region Conservation Authority Mapping Application License Agreement (“License Agreement”)

The St. Clair Region Conservation Authority websites contain mapping applications that allow you to view and search data and generate maps (collectively, the “Licensed Products”). These are licensed to you (“Licensee”) on a non-exclusive, non-transferable and revocable basis by the St. Clair Region Conservation Authority on the terms set out herein.

The SCRCA and its suppliers own and retain all right, title and interest in the intellectual property (“IP”) of the Licensed Products. Rights conferred upon SCRCA by a third party over the use of data which is not SCRCA’s IP is marked accordingly. Licensee acknowledges that all maps generated are copyrighted and must not be altered in anyway.

The SCRCA and its suppliers make the Licensed Products  available “AS IS”, “AS AVAILABLE”, and “WITH ALL FAULTS” without representations or warranties of any kind, either express or implied, as to the accuracy, completeness, reliability, currency, merchantability, fitness for purpose, title or otherwise.  The entire risk as to the results and performance of the Licensed Products is assumed by the Licensee.  The Licensee shall indemnify and save harmless the SCRCA, its directors and officers, its representatives and employees, suppliers and third parties (collectively, the “Indemnitee”) from and against any and all liabilities, damages, costs or expenses awarded against or incurred or suffered by the Indemnitee arising out of any action or proceeding commenced or maintained by any entity in respect of the Licensee’s use of the Licensed Products. The maximum aggregate liability of Indemnitee to the Licensee or any other party for any cause whatsoever related to the Licensed Products shall not exceed $1.

The SCRCA nor its suppliers assume no obligation or liability to provide updates or corrections to, or support for, the Licensed Products, or the provision of notices thereof, to the Licensee.

The Licensee may not transfer, sublicense, sell (commercially or privately), loan, or disclose Licensed Products or otherwise transfer Licensed Products to any third party, except that the Licensee may make maps generated using Licensed Products as permitted by the terms and conditions of the License Agreement and Website terms and conditions. Screen scraping or any such practice, the purpose of which is to obtain data or portions thereof, is prohibited.

This license will terminate immediately without notice from the SCRCA if the Licensee fails to comply with any provision of the License Agreement. Upon termination, the Licensee shall cease all use of Licensed Products and IP and destroy any and all copies of the Licensed Products obtained.

This is a legal agreement between the Licensee and the SCRCA. By accessing the Licensed Products you agree to be bound by these terms and conditions.  This Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Use of SCRCA’s mapping applications constitutes your acknowledgement of and agreement to be bound by the terms outlined above.

Note: Rights conferred upon the SCRCA by a third party over the use of their data is marked accordingly. When generating hardcopy maps using the mapping applications, it is your responsibility to ensure the appropriate citations accompany the map. Mapping applications provided on the SCRCA Web site include data under license from various sources.

The St. Clair Region Conservation Authority is located in southwestern Ontario and includes the Sydenham River watershed and smaller watersheds draining directly into southern Lake Huron, the St. Clair River, and northeastern Lake St. Clair.

The Conservation Authority implements programs to reduce the risk to life and property from flooding and erosion; water and land stewardship; forestry; wildlife habitat creation and outdoor recreation.
